1. Introductory provisions

1.1. These terms and conditions (hereinafter referred to as the "Terms and Conditions") govern the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase contract (hereinafter referred to as the "Purchase Contract") concluded between the seller and another natural or legal person (hereinafter referred to as the "Buyer") via the online store at https://energetickestrechy.cz.

1.2. The Seller is: Ing. Martin Šinkmajer, Company ID: 23134577, with registered office at Litoměřická 120, 411 41 Žitenice, Czech Republic, a natural person registered in the Trade Register (hereinafter referred to as the "Seller").

1.3. Provisions deviating from the Terms and Conditions may be agreed in the Purchase Agreement. Deviating provisions in the Purchase Agreement shall take precedence over the provisions of these Terms and Conditions.

2. User account and ordering goods

2.1. The Buyer can order goods from his user interface. The Buyer can also order goods without registration directly from the store's web interface.

2.2. When placing an order and registering on the website, the Buyer is obliged to provide all information correctly and truthfully.

2.3. The presentation of the goods placed in the web interface is of an informative nature and the Seller is not obliged to conclude a Purchase Agreement regarding these goods. The provisions of Section 1732, paragraph 2 of the Civil Code do not apply.

3. Conclusion of the purchase contract

3.1. To order goods, the Buyer fills out an order form. Before sending the order to the Seller, the Buyer is allowed to check and change the data.

3.2. The contractual relationship between the Seller and the Buyer arises upon delivery of the order acceptance (acceptance), which is sent by the Seller to the Buyer by e-mail.

3.3. The Buyer agrees to the use of distance communication means when concluding the Purchase Agreement.

4. Price of goods and payment terms

4.1. The Buyer may pay the price of the goods and any costs associated with the delivery of the goods in the ways offered in the ordering process on the website (e.g. by bank transfer to the Seller's account or by online payment card).

4.2. Together with the purchase price, the Buyer is obliged to pay the Seller the costs associated with packaging and delivery of the goods in the agreed amount.

4.3. The Seller shall issue a tax document – invoice – to the Buyer regarding payments made under the Purchase Agreement, which shall be sent in electronic form to the Buyer's e-mail address.

5. Withdrawal from the contract (Return of goods)

5.1. The Buyer, who is a consumer, has the right, in accordance with Section 1829, paragraph 1 of the Civil Code, to withdraw from the Purchase Contract without giving any reason, within fourteen (14) days from receipt of the goods.

5.2. For the purposes of exercising the right to withdraw from the contract, the Buyer must inform the Seller of his withdrawal in the form of a unilateral legal act (for example, by letter sent via a postal service operator or by e-mail to info@energetickestrechy.cz).

5.3. In the event of withdrawal from the contract, the Buyer bears the costs associated with returning the goods to the Seller. For oversized goods (e.g. solar panels, pallets with bags), we would like to point out that due to their nature, these goods cannot usually be returned by regular mail and the return costs may be higher than for regular shipments.

5.4. The Seller shall return the funds received from the Buyer within fourteen (14) days of withdrawal from the contract, but not before the Buyer returns the goods to him or proves that he has sent the goods.

6. Rights arising from defective performance and Personal data protection

6.1. The rights and obligations of the contracting parties regarding rights arising from defective performance (complaints) are governed by the Seller's valid Complaints Procedure, which is available on the website.

6.2. The Buyer's personal data is protected in accordance with the GDPR. Detailed information is provided in a separate document, the Privacy Policy.

7. Final provisions

7.1. If the relationship established by the Purchase Agreement contains an international (foreign) element, then the parties agree that the relationship is governed by Czech law. By choosing the law according to the previous sentence, the consumer is not deprived of the protection provided by the provisions of the legal order from which it cannot be contractually deviated.

7.2. If any provision of the Terms and Conditions is invalid or ineffective, the invalid provision shall be replaced by a provision whose meaning comes as close as possible to the invalid provision.

7.3. The Purchase Agreement, including the Terms and Conditions, is archived by the Seller in electronic form and is not accessible.
